Terms of Service.

These terms govern use of the PlotPro platform by builders, their teams, and the end-customers they serve. They should be read together with the Privacy Policy.

1. Who We Are and Acceptance of These Terms

PlotPro is a software-as-a-service platform operated by [PLACEHOLDER: legal entity name and registered address] ("PlotPro") that helps real estate developers digitize, publish, and market plotted, high-rise, and township projects.

These Terms of Service ("Terms") form a binding agreement between PlotPro and every person who uses the platform. A user accepts these Terms by ticking the consent checkbox at account creation, by signing up or signing in with Google, by entering a one-time code or opening an invite link on the customer portal, or by continuing to use the service.

If a user accepts on behalf of a company, that user represents that they are authorised to bind the company.

2. Definitions

  • "Builder" or "Organization" — a real estate developer that holds a PlotPro account and publishes projects through the platform.
  • "Staff" — individual users who belong to an Organization's team.
  • "End-Customer" — a person who browses a Builder's microsite, submits an enquiry, or signs in to the customer portal.
  • "Content" — project data, plot layouts, images, documents, prices, and any other material a Builder uploads.
  • "Service" — the PlotPro platform, including the builder portal, project microsites, the customer portal, and related APIs.

3. Eligibility and Accounts

The Service is available only to persons aged 18 years or older who can form a legally binding contract.

Account holders must provide accurate, current information and keep it updated. Each user is responsible for safeguarding their credentials and one-time codes and for all activity under their account. Organizations are responsible for the actions of their Staff.

PlotPro may refuse, suspend, or reclaim accounts, organization slugs, or subdomains that infringe rights, mislead the public, or violate these Terms.

4. The Service and Subscription Plans

PlotPro provides tools including interactive site plans, project microsites, enquiry management, customer accounts, and analytics. Available features depend on the subscription plan attached to each project, as described on the pricing page.

PlotPro may improve, modify, or discontinue features. Where a change materially reduces a paid plan's functionality, PlotPro will give reasonable advance notice.

5. Billing, Renewals, and Refunds

Paid subscriptions are billed in advance on a recurring basis through Razorpay, PlotPro's payment processor. Enterprise arrangements may be billed through payment links or invoices.

Prices are exclusive of applicable taxes, including GST, which are charged additionally where required by law.

Subscriptions renew automatically until cancelled. Cancellation stops future renewals; amounts already paid are non-refundable except where required by law or expressly agreed in writing.

PlotPro may suspend or downgrade projects on accounts with overdue payments after reasonable notice.

6. Free Trials

PlotPro may offer trial access to paid features. Trials convert to the applicable paid plan or expire at the end of the trial period, as communicated at signup. PlotPro may modify or withdraw trial offers at any time.

7. Builder Content and Listing Responsibility

Builders retain ownership of their Content and grant PlotPro a worldwide, non-exclusive, royalty-free licence to host, process, reproduce, and display it solely to operate and promote the Service.

Builders are solely responsible for the accuracy, legality, and completeness of their listings — including plot availability, prices, dimensions, approvals, and marketing claims — and for compliance with the Real Estate (Regulation and Development) Act, 2016 (RERA), state RERA rules, and all other applicable laws.

PlotPro is a technology platform. PlotPro is not a real estate agent, broker, or party to any transaction between a Builder and an End-Customer, and does not verify listings, titles, or approvals.

8. End-Customer Data Processing

Enquiries, unit allocations, conversation threads, and related End-Customer records captured through a Builder's microsite or the customer portal are processed by PlotPro on the Builder's behalf and on its instructions.

Builders are responsible for having a lawful basis to collect and contact their leads and customers, and for honouring End-Customer rights over data the Builder controls. The Privacy Policy describes this division of roles in detail.

9. Acceptable Use

Users must not:

  • use the Service for unlawful, fraudulent, or misleading purposes, including listing property they are not authorised to market;
  • upload content that infringes intellectual property, privacy, or other rights, or that is defamatory or obscene;
  • probe, scrape, overload, or disrupt the Service, or attempt to access other tenants' data;
  • resell or white-label the Service without a written agreement;
  • misuse one-time codes, invite links, or another person's identity.

10. Intellectual Property

The Service — including its software, design system, templates, and documentation — is owned by PlotPro or its licensors and is protected by intellectual-property laws. No rights are granted except as expressly stated in these Terms.

Feedback and suggestions may be used by PlotPro without restriction or obligation.

11. Third-Party Services

The Service integrates third-party services, including Razorpay (payments), Google (sign-in, Maps, and Street View imagery), ESRI (basemap imagery), Amazon Web Services (hosting), and Brevo (email delivery). Use of those features is also subject to the applicable third party's terms, and PlotPro is not responsible for third-party services.

12. Suspension and Termination

Builders may stop using the Service and cancel subscriptions at any time. PlotPro may suspend or terminate access, or unpublish content, for material breach of these Terms, non-payment, unlawful listings, or risk to the platform or other users — with notice where practicable.

On termination, published microsites and portal access are disabled. PlotPro provides a reasonable window to export data on request, after which data is deleted in the ordinary course as described in the Privacy Policy.

13. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, PlotPro disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Site plans, plot geometry, map overlays, and 3D visualisations are illustrative marketing aids derived from Builder-supplied data. They are not survey documents, legal plans, or a substitute for physical verification and due diligence.

14. Limitation of Liability

To the fullest extent permitted by law, PlotPro's aggregate liability arising out of or relating to the Service is limited to the amounts paid by the claimant to PlotPro in the twelve months preceding the event giving rise to the claim.

PlotPro is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.

Nothing in these Terms limits liability that cannot be limited under applicable law, including rights available to consumers under the Consumer Protection Act, 2019.

15. Indemnification

Builders will indemnify and hold harmless PlotPro from claims, damages, and expenses (including reasonable legal fees) arising from their Content, their listings, their breach of these Terms, or their collection and use of End-Customer data.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Subject to any mandatory consumer-protection rights, disputes will be resolved by arbitration under the Arbitration and Conciliation Act, 1996, seated at [PLACEHOLDER: arbitration city], in English, before a sole arbitrator; courts at the same city have exclusive supervisory jurisdiction.

17. Changes to These Terms

PlotPro may update these Terms from time to time. Material changes are notified through the Service or by email, with the "Last Updated" date revised above. Continued use after the effective date constitutes acceptance of the updated Terms.
